school bus. that weapon was actually a toy gun. >> and another twist. it's coming in the chandra levy murder case, why the convicted killer is coming back to the district to appear in court. thanks for joining us tonight. i'm shawn yancy. >> i'm brian bolter. we'll begin with another smash and grab robbery at a local jewelry store. today's target, frederick, maryland coming one day after a similar crime in arlington, virginia. tonight people are asking are these crimes connected? fox 5's bob barnard is following the investigation. >> the best answer police can give success maybe. the crimes are quite similar. hooded men bursting into jewelry stores in the mid of the day heading right to the expensive -- middle of date heading right to the expensive stuff smashing with a hammer making off with the loot. yesterday was in arlington, this afternoon in frederick, maryland. colonial jewelers, herlitz family owned for 60 years in the heart of downtown

frederick, this its first armed robbery in decades. >> thank god we are okay. >> a surveillance camera was rolling around 1:30 this afternoon when three men stormed the business. >> 30 seconds they were in and out. they came in with a gun, pepper spray, everybody on the ground. our employees are well trained to do exactly what they're old and thank god they did exactly what they were told and everybody went on the ground and they were -- smashed it, smashed the case, abbed the rolexs and out the door they were. >> yes, they went ght for the rolexs. >> reporter: you have a sense they probably knew where those watches were? >> absolutely, yeah. >> she says she thinks the bandits were here scouting their loot a couple weeks ago, might be the same men caught on camera monday smashing a display case inside the zales jewelry store in pentagon city stealing 27 diamond rings. >> i had seen that and when i looked up at my desk and i saw the guy heading toward me, that

was the first thing i thought. they're here, same ones. >> reporter: frederick police say they're looking into that possibility. >> we're in communication with arlington pd. we're reviewing their information and showing them our information and seeing if they link up and if they do, we'll work it cooperatively. >> reporter: in both cases it appears the bandits used a hammer to break open the display cases. in today's caper the hammer was dropped and left behind, their victims left to deal with the effects of being pepper sprayed, but they're all okay physically. >> after today's heist police say the hooded men got away in derek colored suv or truck. it was a red -- a dark colored suv or truck. it was a red sedan that was seen leaving the scene in pentagon city. police believe this woman robbed two banks in a matter of minutes yesterday in northwest d.c. one robbery was in the 3400 block of connecticut avenue, the other in the 4200

block of wisconsin avenue. it's hard to see on the video, but the woman wore a bandage on her face. if you recognize her, call d.c. police. another big story tonight, no doubt schools are on high alert when it comes to anything dealing with guns. today in alexandria a child's toy gun was enough to get him arrested. the suspect is 10. fox 5's will thomas in the newsroom now with the look at what happened. >> he is a 5th grader at an alexandria public school and police say he showed a plastic gun to at least one other student on the school bus. that got back to a parent and it was reported. when the 10-year-old showed up at school today, police arrested him. here's some of the back story. the 10-year-old attends douglas macarth elementary school in alexandria. the trouble for him started monday afternoon on the school bus on the ride home. according to alexandria police, the boy showed a toy gun described as a replica silver handgun with a black handle and orangtip.

police say he neglected to mention the toy was a fake gun. school officials found out and when the 5th grader arrived at school today, they found the toy gun in his bag. police arrested him and took him to the juvenile detention center for booking. he's charged with brandishing a weapon. a short time ago tonight we sat down with the former prince george's county state's attorney glenn ivey and he thinks the kid is getting a raw deal. >> i understand everybody is on edge after the school shootings we've had in newtown and there's been a series of these over the recent years, but at the same time you hope the weekend him doesn't swing too far to the extreme -- pendulum doesn't swing too far to the extreme. i think that's what's happening here. sometimes when you're too heavy handed, you can push the kid in the opposite direction. this might be one of those scenarios. >> reporter: the 10-year-old was released from juvenile detention today. he's also in hot water at

school. the chilwas suspended and the superintendent morton sherman says further action is under consideration including expulsion. more to come on this one, i'm sure, brian. a swim coach whose athletes have included olympians and world record breakers will plead guilty to child sexual abuse. rick curl turned himself in back in october. the washington post reports he will plead on february 21st. a former swimmer named kelly curran says he fondled and kissed her starting when she was 13 and within two years it progressed to intercourse. curran agreed to allow her identity to be public. rick curl trained katie ledecky among other stars. two people are dead after an early morning house fire. the flames broke out in what was supposed to be a vacant row home along r street southeast. fox 5's matt ackland has the story. >> reporter: this video tells a story, a fast moving fire ripped through a row home along r street southeast. the home had been boarded up,

supposed to be vacant, but it wasn't. two people were inside. side. >> one of the victims was found right at the front door. the other one was in the middle living room of the area. >> reporter: janice harkin lives nearby. she walked home quickly when she heard about the blaze fearing it was her place. >> i just got a call to come home, that my apartment building was on fire, but when i got here, saw it was the next one, but still scary. very scary. >> reporter: ladonna muhammad was surprised when we told her two were found dead inside the home. she says it's been sealed off for at least two years. >> i've never really seen anybody go in and out of that building before at all. >> reporter: officials said from the beginning the task of identifying the victims wouldn't be easy. were they squatters, maybe people who lived nearby? hard to say. officials say the bodies were burned beyond facial recognition. >> i hate for anybody to die for anything, but to be burned

to death, that's so tragic. >> reporter: a big part of this investigation is to determine why these people remember inside this home. they still just don't know if the home was sealed up, why those folks remember inside at the time of the fire -- were inside at the time of the fire. in southeast matt ackland, fox 5 news. we are following breaking news in the pacific ocean. a giant earthquake and tsunami is sparking warnings and watches all across the south pacific tonight. the pacific tsunami warning center says an 8.0 earthquake near the coast of the solomon islands generated a tsunami that may be destructive near the epicenter. the warnings are effective for several nearby islands including new guinea and australia and eastern indonesia. a news alert about the standoff between an alabama man and federal authorities. the fbi says jimmy lee dykes engaged in a firefight with

agents before he was killed. the agents were trying to rescue the 5-year-old boy dykes had been holding in an underground bunker for a week. >> reporter: so far investigators have discovered two explosive devices where jimmy lee dykes held a little boy lostage, 1 inside the bunker and one inside the ventilation pipe where he requested agents negotiate with him. the 5-year-old has been reunited with his family. despite being held captive for a week in a bunker, the child appears physically okay. the boy's mother issued a statement saying, "i can't describe how incredible it is to hold him again. ethan is safe and back in my arms. i owe is all to the most compassionate people on earth." the gunman 65-year-old jimmy lee dykes died when fbi agents stormed his bunker yesterday. investigators say dykes runed fire and was killed by agents. today the fbi released new photos of the scene. this picture shows the bunker covered by a blue tent and you can see a pipe negotiators used to communicate with the suspect.

if you've ever driven around the d.c. region, you know traffic is bad, but a new scientific study proves the d.c. area has the worst traffic in the country. researchers at texas a&m used data collected from sensors in highways and major roads. fox 5's john henrehan shows us what they found. >> reporter: jacqueline gill, an analyst who commutes only about 14 miles every morning from fall church to d.c. knows about slow rush hour traffic. >> without traffic 30 minutes. with traffic probably an hour, hour 15 minutes. >> reporter: on a bad day? >> an hour and a half on a really bad day. >> reporter: how often does that happen? >> once a month. >> reporter: well, once again researchers at texas a&m have crunched the numbers nationally and concluded the d.c. area has the most congestion in the u.s. among the highlights in the report, on average motorists here lose 67 hours a year

because of slow traffic costing the average regional commuter an extra $1,400 a year. both figures are significantly ahead of the time and costs of the next slowest regions, l.a., san francisco and new york. the data show freeway travel is particularly unreliable in the d.c. area and we also produce more carbon dioxide emissions per commuter than any other american city. is there hope for our future? maybe in virginia says aaa's lon anderson. >> they're right now working on express lanes on i-95. i think when those connect to the capital beltway express lanes that they've already built through tysons corner to springfield, we might see us lose that no. 1 status. i think there's that possibility. >> reporter: ron kirby who studies traffic at the metropolitan washington council of governments is not particularly optimistic about cutting local congestion. >> a lot of the problem is

outside the beltway, you know, where we have suburban employment and residential growth and relatively little investment in the road capacity or transit, for that matter. so we're not keeping up with the growth. >> reporter: oh, growth, well demographers are predicting both jobs and population in our region will grow in coming decades and as we get by this extended economic slowdown, more traffic is expected to come on area roadways. in arlington, john henrehan, fox 5 news. >> we asked our facebook fans about their daily commutes. brian cameron wrote i drive 57 miles every day from fredericksburg to arlington, rain, snow, wind and the sun won't stop the postal service, but it will make 150,000 people lock up their brakes on 95 south. christy boyd wrote tonight was awful. it took 1.5 hours to go 22 miles, got off work at 5 p.m., walked in the door at 6:30

p.m., took me 40 minutes to go 1.5 miles to get onto 295. cynthia clark wrote i moved from woodbridge, virginia, to prince george's county so i wouldn't have to commute. left work from d.c. at 5:00 and got home at 9:30, won't commute like that anymore. we invite you to join the conversation on our my fox d.c. facebook page. the virginia house passed an amended version of governor bob mcdonnell's major transportation funding reform package which eliminates the $100 fee on new hybrid car purchases and requires legislative approval of interstate tolling but it keeps other major features of mcdonnell's one billion dollars five year plan including a sales tax increase. he's been at the helm for two years now and tonight d.c.'s mayor touted the city's success story. vincent gray delivered his third state of the district message. fox 5's karen gray houston was there and joins us live.

>> reporter: mayor gray ticked off a litany of successes that he says proves that the district is well on its way to becoming a big league world class city and he says he's got big plans for even more improvements. mayor gray arrived to chants from a small demonstration outside the synagogue of residents upset about plans to close city schools, but inside there was a warmer reception from interested citizens, former mayors, cabinet members and members of the d.c. council. they listened to mayor gray go through a long list of how he's made the city better. >> the district is booming with new businesses, new development and newly revitalized neighborhoods. all this economic activity has created 28,000 new private sector jobs in the past two years. [ applause ] >> reporter: he pointed to economic activity on the campus

of st. elizabeth's with microsoft coming and development of the skyland shopping center in ward 7 and said citywide economic activity has created 28,000 private sector jobs in the last two years alone. >> the district's unemployment rate has declined by nearly three full percentage points. >> reporter: and he looked to the president of the united states for support in achieving full democracy. >> i want to thank you, mr. president obama for displaying our taxation without representation license plates. >> reporter: on the touchy issue of ethics the mayor spoke of procurement reform in contracting practices even as he remains under the cloud of a federal investigation where three of his campaign workers have pleaded guilty to campaign corruption. as for reaction to this speech, there was this. >> look where the city is moving, how the city is moving forward both fiscally.

we're fiscally sound. we're the envy of many city ofs in america. >> the -- cities in america. >> the big pronouncement the mayor would like to build 10,000 new units of affordable housing in the district. it's never too late to hear that. >> reporter: mayor gray's vision for this future includes new opportunities for startup businesses and tech companies. he says he also wants to try to stop the flooding in bloomingdale. he's got two more years. >> karen gray houston tonight. the pentagon extending some benefits to same sex partners of service members comes about 16 months after the pentagon repealed its ban on gays in the military, no word yet which benefits will be extended to the spouses of gay and lesbian personnel. the new guidelines will be departing defense secretary leon panetta's final imprint on the armed forces. coming up next we'll show you the crash that sidelined america's top skier for the

this is fox 5 news at 10:00. >> the latest twist in the chandra levy murder case will likely be revealed this week when the convicted killer appears in a d.c. courtroom. in the last two months the presiding judge in the case held two meetings with the prosecution and defense over an issue with a trial witness. fox 5's paul wagner has the latest. >> reporter: it's not unusual for a d.c. superior court judge to hold a post conviction hearing. any number of things could persuade a judge to do it. >> motion for a new trial, newly discovered evidence, perhaps ineffective assistance of counsel, those are generally the categories defendants get post trial verdicts on. >> reporter: what we know is this. prosecutors alerted the judge and defense to an issue involving the prosecution witness, an issue sensitive enough judge fisher ordered the

record sealed. >> if both parties consent, it's easy, but i've objected to it before and lost. >> reporter: what little is on the public record indicates the judge sealed the record for safety reasons. ingmar guandique was convicted in november of 2010 for killing chandra levy on a wooded slope in rock creek park. one of the prosecution's key witnesses was armando morales, a convicted felon and former gang member who said guandique confessed to him in prison. it's unclear if morales is the witness in question. the chandra levy case made international news in 2001 when it was revealed she was dating a married congressman from california, gary condit, also testified at the trial. he denied having anything to do with levy's disappearance and death and has never been charged. it's not insignificant that ingmar guandique will be in the courtroom on thursday. the judge will likely make some sort of ruling since the

defendant is coming all the way from a federal prison in alabama. on wednesday the judge will also hear arguments from the news media that those private bench conferences be unsealed. in the fox 5 newsroom i'm paul wagner. a northern virginia man facing terrorism charges for shooting a security guard this summer is still negotiating a plea deal. floyd corkins is due in court tomorrow. last august police say he walked into the family research council headquarters in northwest d.c. and shot the guard on duty. the guard survived, but before the shooting witnesses say corkins yelled at the guard i hate your politics. baltimore jurors resume deliberations tomorrow in the death of a north carolina teen. phylicia barnes was visiting relatives in baltimore when she disappeared in 2010. her body was found months later in the susquehanna river. michael johnson is accused of killing her. according to the baltimore sun the jury rewatched a video prosecutors say shows barnes, johnson and two others engaged in sexual behavior and they

once they've created an account they simply tell us what websites they think their kids are using and if their child uses a mobile phone, they enter the number. they install an application on the mobile phone from the app store, iphone or android and they're off and running. we start monitoring. >> but important here. this is not spyware. you have to have your child's username and password to make this effective which means you download it on their phone. they'll see the app. it's not hidden. >> i think that's critically important because if you did hide it, no. 1, it could be abused. we don't want that and no. 2 is that if it's a got you moment, you really haven't engaged and educated your child, you've just busted them and the goal is kind of a long term helping your child to govern their behavior. >> once you enter all that stuff what does the app do? does it alert parents if foul language is used? what are some of the key things that could set it off and how is it reported back to the parent? >> sure. it takes all the data out there

and makes it actionable for mom and dad, makes charts and graphs so they can understand what's happening in the digital world and mines the texts looking for risky activities and behaves. it alerts mom and dads -- behaviors. it alerts mom and dads with e- mails or texts to their phone. >> everybody is thinking do you have a slew of i.t. guys monitoring everything going on? how does this work? >> all the data is put in essentially a locked box. our staff can't get to the data. this is all done with a parental intelligence system which is literally churning through the data much like a business intelligence system for a ceo. this is really a parental intelligence system. >> what's the cost? >> ranging from always free to $10 a month. >> go to youknowkids.com, fill out the account, download the app. last question, parenting has really changed because children are not just consumers

two teens are recovering tonight after losing their fingers in a game of tug of war.

it happened at a california high school during spirit week. a girl and a boy lost four fingers from each of their right hands and the girl also lost the thumb of her. officials say the rope was wrapped around the students' hands. it snapped and amputated their fingers. >> many witnessed it, were close to it. many are friends with the students that were injured, so there's a lot of support that's needed. so that's our primary focus. >> the two teenagers are in a los angeles hospital in stable condition. they've also been undergoing hours of surgery to have their fingers reattached. now an impressive encounter with nature caught on camera. an arizona woman witnessed a whale hitting a fishing boat off the coast of mexico. this whale collided with the boat with so much force the boat nearly capsized. everyone says it was also very loud. >> there was a couple of times when the whale came really close to our boat, in fact, one of the times it felt like she slightly nudged us, but she

century the boy scouts of america being asked to change a code of conduct. a group of scouts and their families delivered several boxes to the organization's texas headquarters. inside the boxes they say are more than 1 million signatures calling for an end to its anti- gay ban. >> i don't want one parent to have to tell their son they can't be a part of scouts because they're not good enough. >> i asked the executive board to please end this harmful policy of discrimination. >> reporter: while an alleged 1.4 million people signed the petition, there are countless numbers of others also calling for an end to the ban including one ohio church. >> one of the great benefits of the boy scouts of america program is that it has such a strong emphasis on citizenship and it is just a shame that for all these years people have been excluded from that experience because of sexual orientation. >> reporter: despite the call for an end to the ban not everyone is in favor of a policy change. over the weekend texas governor rick perry spoke out on this

issue. >> scouting is about teaching a substantial amount of life lessons. sexuality is not one of them. it never has been, doesn't need to be. >> meantime british lawmakers have voted overwhelmingly in favor of a bill to legalize same sex marriage. lawmakers voted 400-175 in favor of the legislation. the bill still has to go through more parliamentary debate. if it becomes law it will allow same sex couples to be married in civil and religious ceremonies. kate middleton will make her second official appearance since becoming pregnant. she's been spotted out and about shopping and grabbing coffee. the palace announced middleton will appear february 19th at a gathering. the baby is expected in july. the 15th century english

king is looking better than ever. on monday archeologists discovered the 500-year-old king richard, ii under -- iii under a parking lot. three years ago today the first of back to back blizzards stormed the d.c. area. >> schools closed and metro shut down and i'm glad we're not seeing that about now. >> we were all up the street in a hotel shoveling out. >> i'll never forget 2010, unbelievable. it started in the morning february 5th and by the time it was done we had 18 inches, 32 at dulles and three days later we did it again. we have a little more video because snow lovers have not had a good couple of winters here. the second one was just three days off, less snow but stronger winds blowing between

40 and 50 miles an hour. by the time it was all said and done we got 28.6 inches of snow. that's the famous dupont circle snowball fight and then bwi got 49.5 inches in the first 10 days of february do. you miss it, folks? i'm not sure. some people do. look at this guy snowboarding, too off the back of a car. that was quite a winter. what about this winter? well, we have only had from multiple rounds of the clippers only 1 1/2 inches in d.c. in an average winter by the time we got to february 5th we should have had about 9 1/2 inches, so a couple flurries tonight, that's about it. something we need to watch thursday night, a system coming in and maybe there's a little bit of cold air around we could see a wintery mix thursday night before it changes over to rain, but tonight it's just patchy flurries and sprinkles and a little bit of a warming trend down the road. we're picking that up on doppler radar. this is not going to cause any trucks, just passing flurries

coming -- trouble, just passing flurries coming from this system, and maybe even sleet and sprinkles, which is kind of breaking apart to the west. meanwhile today's temperature 42 degrees and it was still cold in the northeast, boston and buffalo 27, but warmer air will try to make another run at us. new orleans 70, little rock 65, dallas 69, del rio 81 and some of that warm air gets in here starting sunday into next week. in the meantime we'll be stuck with the 40s and maybe some significant rain for us thursday night, friday morning beginning as a wintery mix for some areas. that's a tricky forecast we'll watch. it's 37 degrees in the district, 32 in gaithersburg and frederick, 30 degrees in manassas, so not real cold, but i bet we see our temperatures drop down to the 20s in some areas. the next two days sun makes a comeback tomorrow. we'll get up to about 45 degrees.

there will be a little breeze from time to timeout not that blustery. thursday we start out sunny and most of the daylight hours will be dry. we do expect to see moisture coming up from the south, but it doesn't get here till 10:00 or 11:00 at night. we'll see whether or not that precipitation initializes as a mix or snow. tomorrow we'll be on the cool side due to high pressure off to our west brings in a northwest breeze and keeps us cool, but it will chase the clouds out. thursday after the high kind of departs we stay chilly thanks to the position of the high and then all eyes down south as this area of low pressure is not a clipper this time. there might be a clipper involved up north, but it will be a southern system we'll watch, mostly looks like it will be quite a bit of rain for d.c. south and east. here's futurecast so you can see how this model is showing it. of course, it's picking up on a couple of sprinkles and

flurries tonight, sunshine tomorrow. we start out thursday sunny and the clouds increase, but notice at 6:00 there's no precipitation at all. then we look down south and by 11:00 at night here comes a bit of rain, but you get closer to interstate 81 and that's a mix of snow and sleet. we run this out to afternoon clock or 8:00 in the morning and maybe on the -- 7:00 or 8:00 in the morning and maybe on the edge a little rain. friday morning it may be a little south and east before it chases out of town probably late morning into the early afternoon. your fox 5 accuweather seven- day forecast has a lot of up and down on it. we'll start with temperatures rather moderate tomorrow at 45, average for this time of year, a little chilly thursday, very wet potentially for the late hours on thursday into friday, maybe a bit of wintery mix to start that out. once we get to the weekend by sunday 51 degrees, monday 55 and tuesday 54.

prosecutors want an l.a. judge to revoke singer chris brown's probation. they say there's no credible evidence he completed his 180 hour community service sentence for beating rihanna. despite paperwork from richmond's police chief those 180 hours were completed, l.a. prosecutors say there are too many discrepancies. they want the judge to order brown to repeat all 180 hours of community service in l.a.
